1. Overview

These Terms of Use ("Terms") govern your access to and use of mrextinctor.com (the "Site") and your relationship with Mr. Extinctor ("Mr. Extinctor," "we," "us," or "our") more generally. By accessing the Site, requesting a quote, scheduling service, or otherwise interacting with us online, you acknowledge that you've read, understood, and agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use the Site.

2. Changes to These Terms

We may modify these Terms, the Site, or its content at any time, for any reason, without prior notice. The updated version will be posted here with a new "Last updated" date. Continuing to use the Site after changes are posted means you accept the revised Terms.

3. Jurisdiction

This Site is directed to residents and businesses of the United States, and specifically to the New York metropolitan area where we operate. We make no claim that the Site is appropriate or available for use outside the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

4. Additional Terms

Certain services — including AutoPay, recurring service plans, and our SMS program — have additional terms specific to them, which are incorporated into these Terms by reference. If there's a conflict between these Terms and terms specific to a service, the more specific terms control for that service.

5. User Content

If you submit a review, testimonial, photo, or other content to us — by email, phone, text, or through a review platform — you grant Mr. Extinctor a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, publish, and display that content in our marketing materials, including on this Site and our social media. You're solely responsible for any content you submit, including making sure it's accurate and doesn't infringe on anyone else's rights.

6. Eligibility

The Site is intended for business owners, property managers, and other adults seeking commercial pest control services. You must be at least 18 years old to request service, create an account, enroll in AutoPay, or submit information through the Site.

7. Your Account

If we offer you account access (for example, to view service history, invoices, or manage AutoPay), you're responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at info@mrextinctor.com if you suspect unauthorized use of your account.

8. AutoPay

If you enroll in AutoPay, you authorize Mr. Extinctor and our payment processor to automatically charge the payment method you provide for recurring service plans and other amounts owed to us, on the schedule disclosed to you at enrollment.

• This authorization remains in effect until you cancel it or we terminate your service.
• You're responsible for keeping your payment method up to date. A declined or expired payment method may result in a billing retry, late fee, or suspension of recurring service until payment is resolved.
• You can cancel AutoPay at any time by contacting us at info@mrextinctor.com or (555) 123-4567. To avoid being charged for an upcoming cycle, cancel at least 3 business days before your next scheduled billing date.
• We'll provide advance notice before any change to your recurring price, consistent with applicable law.
• You'll receive a receipt or invoice for each AutoPay transaction.

9. Copyrights and Trademarks

The Site, including its text, graphics, logos, and design, is owned by Mr. Extinctor or our licensors and is protected by copyright and trademark law. You may view and print pages from the Site for your own personal, non-commercial use, but you may not otherwise copy, modify, distribute, or create derivative works from the Site without our written permission. "Mr. Extinctor" and our logo are trademarks of Mr. Extinctor and may not be used without our prior written consent.

10. Links

The Site may contain links to third-party websites for your convenience. We don't control and aren't responsible for the content, accuracy, or practices of those sites. Linking to a third-party site doesn't mean we endorse it.

11. Use of the Website

You agree to use the Site only for lawful purposes. You may not:

• Use the Site in any way that could damage, disable, or impair it
• Attempt to gain unauthorized access to any part of the Site or our systems
• Submit false, misleading, or fraudulent information through our forms
• Use any automated system (bots, scrapers, etc.) to access the Site without our permission
• Use the Site to transmit any harmful code or unsolicited advertising

Submitting a form, calling, or texting us to request an inspection or quote does not, by itself, create a binding service contract. Pricing, scope of work, and scheduling are confirmed separately once we've assessed your property.

12. DMCA Copyright Policy

If you believe content on the Site infringes your copyright, you may send a notice to info@mrextinctor.com that includes: (a) a description of the copyrighted work you claim has been infringed; (b) the location of the material on our Site; (c) your contact information; (d) a statement that you have a good-faith belief the use is unauthorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you're authorized to act on the copyright owner's behalf. We'll respond consistent with the Digital Millennium Copyright Act.

13. Disclaimer of Warranties

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Site will be error-free, secure, or uninterrupted.

14. Limitation of Liability

To the fullest extent permitted by law, Mr. Extinctor will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed the amount, if any, you paid us in the 12 months before the claim arose. This section does not limit liability that cannot be limited under applicable law, and it does not apply to liability arising from services performed at your property, which is governed by the separate service agreement you sign with us.

15. Text Message Program Terms

This section explains the terms and conditions for text message ("SMS") communications between you and Mr. Extinctor.

Program Description

By opting in, you agree to receive recurring text messages from Mr. Extinctor related to:

• Appointment confirmations and reminders
• Technician arrival updates
• Quote follow-ups and service updates
• Occasional promotional offers or seasonal reminders (for example, recurring service renewal)

How to Join

You can opt in by:

• Texting us first using the "Text Now" button on our Site
• Providing your phone number and consent through our contact/inspection request form
• Verbally providing consent to a Mr. Extinctor representative by phone

By opting in, you confirm that you are the account holder or authorized user for the phone number provided.

Message Frequency

Message frequency varies depending on your active appointments and whether you've opted in to promotional messages. You can generally expect anywhere from 1–4 messages per month, more often if you have an upcoming or recurring service appointment.

Cost

Message and data rates may apply, depending on your mobile carrier and plan. Mr. Extinctor does not charge you for text messages, but your carrier's standard messaging rates apply.

How to Opt Out

You can cancel text messages at any time. Just reply STOP to any message we send you. After you reply STOP, we'll send a final confirmation text and you won't receive any further messages from this program, unless you opt back in later. If you'd like to opt back in, just text us again or let us know by phone or email.

Carrier Liability

Mobile carriers supported by this program are not liable for delayed or undelivered messages.

Privacy

Your phone number and any information shared through text messaging is handled according to our Privacy Policy. We do not share your mobile information with third parties or affiliates for marketing or promotional purposes.

Supported Carriers

This program is available on major U.S. wireless carriers. Coverage and features may vary by carrier and are not guaranteed.

16. Inaccuracy Disclaimer

We work to keep information on the Site accurate, but the Site may contain typographical errors, inaccuracies, or omissions, including in pricing or service descriptions. We reserve the right to correct any errors and to update information at any time without prior notice.

17. Browsing Session Information

We may use standard session technology (such as cookies or similar identifiers) to keep the Site functioning properly, remember your preferences, and understand how the Site is used. See our Privacy Policy for more detail.

18. Privacy

19. Termination

20. Informal Dispute Resolution

Before filing any formal claim relating to the Site or our services, you agree to first contact us at info@mrextinctor.com and describe the dispute so we can attempt, in good faith, to resolve it informally. If we haven't resolved the dispute within 60 days, either party may proceed under the Arbitration Agreement below.

21. Arbitration Agreement & Waiver of Certain Rights

Please read this section carefully — it affects your legal rights.

If informal resolution doesn't work, you and Mr. Extinctor agree that any dispute arising out of or relating to these Terms, the Site, or our services will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

• The arbitration will be administered by the American Arbitration Association (AAA) under its rules then in effect, and will take place in New York County, New York, or another mutually agreed location, or by phone/videoconference if permitted by the AAA rules.
• Class action waiver: You and Mr. Extinctor each agree to bring claims only on an individual basis, and not as a plaintiff or class member in any purported class, collective, or representative action.
• Opt-out right: You may opt out of this arbitration agreement by sending written notice to info@mrextinctor.com within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out of arbitration.
• If any part of this arbitration agreement is found unenforceable, the rest of this section will remain in effect, except that the class action waiver may not be severed from the obligation to arbitrate individual claims.

22. Indemnity

You agree to defend and indemnify Mr. Extinctor against any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your breach of any payment authorization (including AutoPay).

23. Other Provisions

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and (subject to the Arbitration Agreement above) any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in New York County, New York. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision isn't a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them freely.
